General
This Privacy Notice applies to information aquatherm LP (“aquatherm,” “we” or “us”) collects when you use aquatherm Mobile Application (App). This Privacy Notice describes the information we collect, use, and share about or from you. By using the App, you agree to the terms of this Privacy Notice and other agreements referenced in this Privacy Notice and consent to our collection, use and disclosure of Personal Information, as described in this Privacy Notice.
Collection of Information
Information You Provide to Us
We collect information you provide directly to us through the App. For example, when you create an account or input information regarding, your company, our products, or your project.
The types of information we may collect include Personal Information. Personal Information is information that can be used to identify you (alone or in combination with other information), including your first and last name, email address, zip code/post code, phone number, user name and password, photographs (that include an individual and any other personally identifiable information)) you choose to provide. As permitted by applicable law, non-Personal Information may be used and shared without obligation to you, unless we specify otherwise when the non-Personal Information is received or collected.
In particular, we have collected the following categories of personal information from users within the last twelve (12) months:

Not included in the definition of Personal Information is information that is publicly available, information that has been de-identified or aggregated, or information exempt from the purview of the CCPA, such as:
- Protected Health Information (“PHI”) governed and protected by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and the California Confidentiality of Medical Information Act (“CMIA”) or clinical trial data; and
- Personal Information regulated by certain industry-specific privacy laws, such as the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA), California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
Information We Collect Automatically
We, and our service providers may automatically collect certain information about you when you access or use the App, including device type; operating system characteristics; information about your use of the App; MAC address, device or session ID, error related data status, capability, performance data, and connection type. This information is not Personal Information unless it is identifiable to you, becomes so in combination with other information, or is deemed to be as a matter of law. For example, we may collect your device’s IP address, which is considered Personal Information in some jurisdictions. This automatically-collected information is in some cases obtained from location-identifying Technologies, such as GPS (global positioning systems) software, geo-filtering and other location-aware technologies and is used to locate where you are or make assumptions about your location. The App uses location-identifying technology to better understand our user base and make the uploaded information of more use to you. You will be asked whether you consent to such use before the first time the App uses GPS or other location-based features. If you have enabled GPS or use other location-based features for the App, your device location (and therefore your location) may be tracked.
The technologies we use for automatic information collection may include:
Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App.
Web Beacons. Pages of the App may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the aquatherm, for example, to count users who have visited those pages.
Google Analytics to monitor activity and performance of our App. To learn how Google Analytics collects and processes data, please visit: “How Google uses data when you use our partners’ sites or apps” located at http://www.google.com/policies/privacy/partners.
To opt out of: (i) Google Analytics install the Google Analytics opt-out browser add-on and (ii) Google’s ad serving.
If you do not want us to collect this information you may manage your data preferences by navigating to the Manage Data page within our App. Note, however, that opting out of the App’s collection of location information will disable its location-based features.
You may also visit The Network Advertising Initiative for Consumer Opt Out, which provides information regarding targeted advertising and the “opt-out” procedures of NAI members. You may also want to visit the Digital Advertising Alliance Consumer Choice Page, which provides information regarding targeted advertising and offers an “opt-out” by participating companies in the DAA Self-Regulatory Program.
Please note that these third-party advertising companies may still collect information from you and opting out through these mechanisms does not opt you out of being served advertising. You may continue to be served generic ads while online or on your device.
Use of Information
We may use your Personal Information for various purposes, including:
- Facilitating and improving the App and your experience using the App;
- Processing your registration for the App;
- Managing your account;
- Responding to your comments, questions and requests;
- Sending you information, updates and administrative messages about the App;
- Contacting you about the App, your use of the App or about changes to this Privacy Notice;
- Providing you with information about our products, installations, computations, and other content or materials available through our App; or
- With your consent.
Sharing Your Information
Our service providers may have access to or receive from us your Personal Information to enable us to provide you with the App and process the information we receive from the App. For example, we store information received from the App on a secure server provided by Amazon Web Services (or a successor providing similar services with similar data protection controls as Amazon Web Services). Our service providers are not authorized to use your Personal Information, except to provide services to us. We may also share your Personal Information in the following ways:
- As required by law and at the request of governmental authorities conducting an investigation;
- To defend, protect, or enforce our legal rights;
- With our affiliates for their legitimate internal business purposes;
- In connection with, or during negotiations of, any proposed or actual corporate transaction (such as a sale of assets or stock, merger, consolidation, or other reorganization); or,
- With your consent.
We may disclose your personal information for a business purpose to the following categories of third parties:
- Our affiliates;
- Our service providers;
- Third parties to whom you or your agents authorize us to disclose your personal information in connection with the services, products, or materials we provide you.
In our sole discretion, we may share aggregated and other non-Personal Information as permitted by law. Under no circumstances does aquatherm sell personal information.
Users and Use Outside United States
We are based in the United States and the information we collect is governed by the laws of the United States. If you are accessing the App from outside of the United States, please be aware that information collected through the App will be transferred to, processed and used in United States.
Minimum Age
The App is not intended for use by individuals under 18 years of age. We do not collect Personal Information from minors. If you are a parent or guardian and believe we have collected Personal Information about your minor child, please contact by using the information at the end of this Privacy Notice under Contact Us.
Individual Rights
Any Personal Information collected by or through the App will be used only for the purpose it was provided and as described in this Privacy Notice.
Some jurisdictions (state, commonwealth, federal, national and international), such as California and the European Economic Area (under the General Data Protection Regulation (GDPR)), provide individuals with certain rights regarding their Personal Information. To exercise any rights your jurisdiction may provide, contact us by using the information listed at the end of this Privacy Notice under Contact Us. The following are examples of individual rights which GDPR provides European residents;
- Being informed about your Personal Information;
- Viewing and obtaining a copy of the Personal Information we maintain about you;
- Amending or revising the Personal Information we maintain about you;
- Having the Personal Information we keep about you erased (also known as the right to be forgotten);
- Objecting to the use of your Personal Information for direct marketing;
- Restricting our use of the Personal Information we maintain about you;
- Transferring the Personal Information we maintain about you to another entity;
- Objecting to our use of the Personal Information we maintain about you;
- Objecting to automated decision making or profiling. We do not make automated decisions about you and do not profile individuals through the App; and
- Filing a complaint with us or the appropriate governmental entity.
If you are a California resident, you may have certain rights with respect to your personal information including the following rights.
- the right to know, by way of our Privacy Notice and any specific inquiries you direct to us, where personal information we have about you comes from, what we use that information for, whether it is being disclosed or sold, and to whom it is being disclosed or sold;
- the right, with some exceptions, to have your personal information deleted from aquatherm’s possession or control; and
- the right to receive equal service and pricing from aquatherm even if you exercise any of your privacy rights.
For both EU and California residents, any such inquiries shall be responded to within the allotted time period under the applicable legislation and shall be at no cost to you. We may reasonably deny your request as permitted under applicable law or inform you of any impact such request may have on your ability to use our App, but we will not discriminate against you for exercising any of your individual rights listed herein. If your request is denied, we will inform you of such denial and provide an explanation regarding the same.
California Civil Code Section 1798.83 permits users of the App who are California residents to request certain information regarding aquatherm’s disclosure of personal information to third parties for their direct marketing purposes. To make such a request, or if you have any questions or concerns about your California privacy rights, our Privacy Notice or our use of your personal information, please contact us using the information at the bottom of this Privacy Notice.
If you are a California resident under the age of 18, and a registered user of any App where this notice is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
We may require that you verify your identity before exercising your individual rights under any of the laws stated above.
Accessing Your Information
You can review and change your personal information by logging into the App and visiting your account profile page. You may also contact us at the email address listed below to request access to, correct, or delete any personal information that you have provided to us. We may not be able to delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
Data Security
We take reasonable steps to have physical, electronic and procedural safeguards in place to protect your Personal Information. Unfortunately, no data transmission can be guaranteed to be 100% secure and while we strive to protect your Personal Information, we cannot guarantee the security of any information collected through the App.
Changes to This Privacy Notice
We may amend this Privacy Notice from time to time. If we make any changes, we will notify you by revising the date at the top of this Privacy Notice, and in some cases, we may provide you with additional notice. Any changes will be effective immediately upon posting of the revised Privacy Notice. Your continued use of the App indicates your consent to the Privacy Notice then posted. If you do not agree with the current Privacy Notice, you must discontinue use of and uninstall the App.
